Business Dispute Resolution Through Arbitration and Mediation: Challenges and Prospects in Commercial Practice from an Islamic Law Perspective

Business disputes frequently arise from contractual and commercial conflicts. Litigation is often considered inefficient due to its cost, duration, and adversarial nature. This study examines arbitration and mediation as alternative dispute resolution mechanisms from the perspective of Islamic law, where they correspond to tahkim and sulh. Using normative legal research, the study analyzes statutory regulations, legal doctrines, and Islamic legal principles. The findings show that arbitration and mediation provide efficiency, confidentiality, flexibility, and opportunities for consensual settlement, consistent with the objectives of Islamic law. Strengthening legal frameworks and institutional capacity is necessary to optimize their implementation.
